Micki,

AAM anticipated that the BMI letter would raise a lot of questions and
our Information Center is working with the Intellectual Property Manager
at the Art Institute of Chicago to develop a fact sheet on music
licensing in museums. The fact sheet helps museums determine when they
need to obtain a license and how to do so and explains what's allowed by
fair use. The fact sheet will be posted on the AAM website by the end of
next week. Login at www.aam-us.org <http://www.aam-us.org/> and then
follow this path: Information Center > Collections Stewardship > Ethical
& Legal Collections Issues > Rights & Reproductions.

Also, Micki, because your museum is an institutional member of AAM, you
can always send questions to the Information Center directly. Customized
reference service is one of your membership benefits. Here's their email
address for future reference: [log in to unmask]
<mailto:[log in to unmask]> . I've asked them to send the fact sheet
to you as soon as it's ready.

Best,
Del

Subject: [MUSEUM-L] Fee for playing CD?

I would like to hear from other small museums about paying a fee
to BMI (Broadcast Music, Inc) for playing a CD as background to an
exhibit. I bring CDs in from home, some played as background "mood" for
a period room, others in my office to keep me company. BMI claims that
because the public has access to both the exhibits and my office, I have
to pay them $350 each year to play my CDs. Well, close the door and I'll
tell you what I think of that. But in order to get the name of our
obscure, remote, rural museum, they must have photocopied the pages of
museum directories everywhere, so someone has probably dealt with this
issue?
