I have two separate issues regarding photo collections, and am hoping that someone out there would be kind enough to share information.
We recently acquired our first substantial photo collection, and while we originally had no short term plans to sell/license reproductions, we have had several requests which make it clear that there is a demand, and that we need to develop processes, documentation, and fee structures. Copyright is fairly clear here, the images are mostly by a single photographer and we have been assigned the copyright/full ownership through the deed of gift. There are some unmarked images, we are working with the donor to look into who took these images. I have dealt with distribution of images, but largely for research purposes, so I am looking for coverage for commercial use. I'm hoping to collect a sample of licensing agreements and rate cards.
The second issue is new to me. We have had several offers be folks willing to let us scan their images, and who are willing to sign over fairly generous use agreements (exhibit, promotion, advertisement, just not distribution or sale), but they want to retain the original print, and copyright. As these are generally not professionals, but private individuals, they do not have their own forms or the legal resources to create one. Therefore I'd like to develop one that we could have them fill out. Neither our loan form (which we have them fill out for the hard copies), or deed of gift, do us much good here. So basically am looking to see fi others have encountered this and if they have standard forms that have worked for them. Am assuming less is more here.
