Peter has it. Most commercial photographers will not sign a contract
that states work for hire since it is an ambiguous clause that has had
many differing interpretations in case law. Ownership of the photo is
with the commercial photographer, who makes his/her money by charging
fees for each use. If a museum wants the photographer to transfer
his/her copyright to the photo, to the museum, state it in the contract.
