My best guess is that the federal government still has title and therefore
the works are not copyrighted and may be re-used freely. This is not fair
to the artists, but that seems to be the case. There are many photographs
which were taken by the likes of Ansel Adams during the same WPA era which
are now being reproduced for calendars, etc. The producers use the
negatives (gov't property) rather than the Adams prints (property of the
Adams estate) and this is so noted on the back of the calendar along with
the mention that no money goes to the estate.
