Whenever I have to answer these legal issue type questions, I go to my trusty copy of "A Legal Primer on Managing Museum Collections" by Marie C. Malaro (Smithsonian Institution Press, 1998). She discusses permanent loans in the chapter on Loans: Incoming and Outgoing.
