For those of you interested in the issues of fair use and publication rights: The College Art Association (U.S. and Canada) contained a set of guidelines for its members in the November 1997 "CAA News" called "Reproduction Rights in Scholarly and Educational Publishing." It is a proposed national policy for the granting of reproduction rights in art historical publishing.
