Another point we ran into when researching the possibility of using interns
from retail training programs for our gift shop--according to the Fair Labor
Standards Act, unpaid interns are considered "trainees," must be supervised
by a trained professional at all times and may not displace regular
employees; also, the employer "derives no immediate advantage from the
activities of students and on occasion the operations may actually be
impeded by the training," and that the intern is not working more than 50%
of the time, instead, is in a "learning or shadowing mode."
