Hi,

besides the due quotation in scientific works for legal reasons, there is also the level of credits, expressions of thanks, gratitude etc. under the picture or at the end.

When we, at Museum & Society, publish a photo, either the copyright (if it exists) or an attribution to the photographer is always used. Museum & Society authors retain copyright in their published work. The Journal retains the right, always, to be named as first publisher. I think the Museum can retain the right to be named as the source of the scans while not retaining copyrights to the actual text/recordings.

I am no expert either, but it is not the aim and the intention of the copyright law and similar legal provisions worldwide to hinder, slow down or completely prevent scientific research. If the source, the owner of a source and its traceability is scientifically quoted by the archive number or inventory number, texts and pictures (including pictures of texts) can be published in scientific works (including dissertations) without asking. If this dissertation is subsequently published 1: 1 by a publisher (mandatory in many universities) and not e.g. shrunk to a coffeetable book, absolutely nothing changes the character of the work - namely, being a scientific publication. Even if the publisher and author make some money with it.

I’m no expert in this area, but I’m guessing that if the transcripts will be used in a dissertation, one could argue that they are being used for educational purposes and copyright would not be an issue. If the dissertation is later published, then it would become a matter for further discussion.

The researcher is interested in referencing the transcripts of a series of interviews with African Americans in our area; the same interviews resulted in the publication of a book of oral histories. In the instance that no restrictions were put in place, it seems pretty cut and dry to be able to supply this researcher with the scans of the transcripts--I guess where I'm still at a loss is whether scans of the transcripts used as images in a dissertation presents any infringement issues or necessitates some kind of notice or something similar in the citation?
