I think the point is that money raised from the sale of a collection piece should only be used to foster the collection—not to provide general operating funds.

On the heels of the controversy surrounding the Detroit Institute of Art's commodification by emergency managers handling the City of Detroit's bankruptcy, Randolph College's actions (letter below) should spur the national museum community to action.

Is there anything going on that anyone is aware of pushing forward legislation in states/at a national level to ensure that donations such as "Men at the Docks" aren't at the mercy of those who are not bound by museum codes of ethics?  In the idealistic, academic setting of grad school, we were trained that museum collections are not assets and should never appear on a balance sheet as such; we are bound by the IRS as museum professionals not to perform appraisals for the same reason.  Why then are other managers and institutions that might have some oversight of museums not bound by the same?

How does the museum community explicitly get it legally clarified that collections held in the public trust are not available for fundraising?  What actions are we actually taking?
