Unless the same questions are asked of each applicant who is interviewed for a post, the employing organization can face legal action based on an allegation of discrimination. As a matter of professionalism, I feel, questions regarding one's personal and family life are off limits. Some governments, including Virginia's, have prohibited government interviewers from asking such things.
