Comparable perhaps to publishing independently on research performed as faculty of a university, this does not necessarily sound like a conflict of interest.

Subject: [MUSEUM-L] Conflict of Interest?

Greetings from a new subscriber, former lurker . . .

I would be very grateful for professional opinions on the following scenario:

A museum curator signs a contract with Arcadia Publishing to produce a title in their Images of America series. The curator is the copyright holder / royalty recipient. The 216 images used in the book are almost entirely from the collection of the curator's institution. The institution normally charges image reproduction and publication fees - but did not charge the curator any fees for use of the images in this book. The curator promotes the book in the media and does not reveal the fact that they will gain personally from the sale of the book. The institution stocks the book in the gift shop, promotes it online, etc.

In your opinion, does this present a conflict of interest and/or misuse of collections?

Thank you for your assistance,

Beth
