Great questions!  I too, am looking for answers to these same questions.  For some reason, photo policies tend to be confusing.  Currently, when a photograph is donated to us the Gift Form does say that we are entitled to do with it what we want, but we have also had the offer to scan photographs without getting the originals.  I'm hoping some folks out there have dealt with this too.
