Hello--
        I've never heard that copyright holders can set the standards of
fair use. In fact, the problem seems to be what has been called
"overstatement of copyright" where the holder claims rights which are not
his/hers, basically as a bluff.
        In terms of suing, anyone in this country can sue anyone for
anything, should they care to spend the money. Reality sets in when the
case is judged, which may explain why there are no relevant court cases
for the lawyers on this list to cite.
