As a newly opened small county museum, we have objects dropped off
everyday, often with volunteers who should not make a determination
about what the Museum should keep. We began by giving everyone a
Temporary Custody Receipt which clearly indicates that the objects
are unconditional donations and signed by the donor. However, our
backlog means that the Deed of Gifts may not have gone out until 3-6
months after the gift arrived and we have problems with returns.
One of my volunteers suggested that we have the donors sign the Deed
of Gift (but not a museum staff member) whenever somebody drops off
the object to solve the return problem. We would then send the Deed,
signed by us, only when we accept the object. From the requirements
described by Janice Klein, it sounds like as long as the Museum does
not acknowledge the gift by signing the Deed, the intent to accept is
not legally binding. My argument to her was that if we decide not to
accept the item, people will be surprised and hurt if we call them to
take their objects back. I suggested that it was a matter of
reputation and the impression we give to donors. Are there any other
arguments I should be making?

There were certainly enough horses in the United States to provide a
thriving hide and hair business in the nineteenth century. According
to the census, by 1890, the North Central states alone had over 9 1/4
million horses, mules and asses. Add nearly 2 million from North
Atlantic, 1 1/4 from the South Atlantic, nearly 3 1/2 million from the
South Central states, and 1 1/2 million from the Western states, and
you had about 17 1/2 million horses in the country. There were
proportionately fewer in previous decades, but it was a steady growth
to 1890, roughly doubling from decade to decade.

I disagree with the commentator who suggested horses lived only about
10 years in the 19th century. That age is roughly accurate for the
average lifetime of working oxen, but horses lived a much longer life.
Oxen were butchered and eaten and turned into cowhide. Horses were
mostly slaughtered and turned into horse hide only, a much less
profitable use than meat and hide.

Very true. Past Perfect has a form for temporary custody, which makes
this very easy. You can print off blank forms and leave them at your
admissions area. It has a place to check that it is an unconditional
donation, etc. as well as contact info. and a signature. However, donors
should be very strongly discouraged from leaving things without speaking
with someone in collections - that's how we end up getting stuff from
the 20th century left when we're a 19th century museum! Very annoying.
In any case, Past Perfect's form is helpful to use.

Sabrina, you're right. I've had that happen. Heirs often think that they
can
claim things their parents or grandparents "left at the museum" long
ago, so
you do need to have some proof of legal ownership. The older the
collection,
the more likely you will have to field such requests from later
generations.
From a long ago seminar on legal aspects of museum work, I learned that
a
good way to back up that nicely typed Deed of Gift which makes the donor
feel that you have made much of his gift, is to have the donor sign a
Gift
Receipt when the donation is brought in. It would be the paper on which
you
get the donors address and information about the item(s) when the
donation
comes in, often, especially with large groups of items, prior to making
a
decision about actually accessioning into the collection. That way, if
the
donor doesn't return the typed DOG, (as someone pointed out most return
it
the first try, more on the second, but a few never do) you still have a
signature stating that it was given to the museum as an unrestricted
donation.
The Gift Receipt is usually hand written and sometimes messy as you have
made notes by listed items, adding in the information they give you
about
where, how and by whom the item was used, etc., so it is still an
important
PR thing to send the nice looking Deed of Gift document for your (and
their)
permanent records. The Gift Receipt should also record their preference
about disposition ("dispose of as museum sees fit", etc.)in case the
museum
decides not to take all the offered items and gives you a clear record
of
accountability should you be unable to get them to return to pick up
non-accessioned items.

I agree. I'd think that without a deed of gift, which is really a legal
document, that a donor or other family members could easily come back
and say that the museum was wrong- it was a loan, not a gift, etc. and
that just because we have a letter from the museum saying it's a gift
doesn't prove their intent...and so forth.
I guess I'll have to take a look at the RCAAM-L archive.

This topic has been much discussed on the Registrars listserv (RCAAM-L).
A Deed of Gift is not a legal requirement, it is "only" museum
policy/procedure. For a gift to be legally valid three things need to
happen:
1. an offer needs to be made
2. the offer needs to be accepted
3. the object needs to be physical transfered to you
If you have all three of those things, the object is legally yours.
The Deed is a Nice Thing to pull all three of these together, but it is
not
required. If you have a piece of paper (even a temporary receipt) that
says the object was offered as a gift, a letter thanking the donor for
the
gift and the object itself, you have all that the law requires.
Having said that, I usually don't send out the IRS 8283 Form until I
have a
signed Deed. But if the donor doesn't want the IRS form and doesn't
send
back the Deed, I don't bug them.

Subject: Re: Returning Deed of Gifts
No one's mentioned my favorite tactic. I used to send the second copy of
the Deed of Gift as "return receipt". Then the little green post card was
proof the donor got my letter. Often this gave my letter enough perceived
importance that the donor signed and sent back the D-o-G.
I also used a carefully worded deposit receipt for items brought in to the
museum. It gave us the right to dispose of items after a period of time
past notifing the donor we didn't intend to accept their object. Potential
donors were asked provenance questions as well and completed an
information form. For most donors (local history museum) this helped them
understand that we were just as interested in the story associated with
the object as the object itself. I co-authored a technical leaflet for the
Illinois Heritage Association (TECH. INSERT 101 (Sept.-Oct.
1999): "Documenting Collections," by Diane Gutenkauf, Sally DeFauw, and
Steph McGrath.) that can be purchased from them at:

for content on donor plaques. We've come up with some basic language we
plan to use, but would like to know what others do. And, do you have any
special ways of handling unusual situations. For instance, if you had a
company who wants to sponsor an exhibit in honor of their founder who
recently passed away, how would your museum handle the text for this plaque?
Simplicity is key, but not offending potential donors is too. Any advice on

Spaces are still available in the following SOLINET Preservation class.
Any institution in Virginia may send participants at the member rate,
thanks to a grant from the National Endowment for the Humanities,
Division of Preservation and Access. Students of library or archives
programs may attend at half-price. Any institution sending three
participants to this class receives an additional free registration to

****DIGITAL LIBRARY PROGRAM DEVELOPMENT****
As institutions collect and provide access to increasing amounts of
digital data, they also may look to improve access to existing
collections in a variety of formats. This one-day class will discuss how
to coherently create, integrate, and sustain new digital resources and
programs, such as imaging projects, within existing resources and
programs. Digital Library Program Development identifies the knowledge
necessary to begin developing local digital resources in a responsible,
sustainable, and systematic manner.
Topics to be addressed within the context of building the program
necessary for creating and providing access to digital information
include:
*Program planning and development
*Standards
*Workflow analysis
*Lifecycle management
*Assessing and supporting user needs
*Collaboration in production and access
*Evaluating and managing technology in support of the program and
patrons
*Establishing policies and standard procedures
*Integrating program activities with other related library activities.
Instructor: Toby Graham, Director of the Digital Library of Georgia
Location and Time: Monday, July 25th, from 9am to 4pm at the Roanoke
Public Library in Roanoke, VA
Intended audience: Staff responsible for the development, management,
and administration of new digital library programs.
Cost: $195 for SOLINET members, $235.00 for non-members. Students of
library or archives programs may attend at half-price. Any institution

We ran across this same problem when we aquired
pastperfect. Our last database did not organize the
records by accession number or object ID but by a key
# that was assigned automatically when the records
were created.
I am currently in the process of changing this system
and have been assigning object id #'s based on the
type of material. Posters, Maps, and Moving Images in
our collection are organized based on a classification
system so I use the classification number and the
original key number.
Our object collection is of course in the same
predicament as you all and is almost entirely
accessioned while the archive collection does not have
enough documentation.
It's hard to try to start from scratch and it seems as
though each Museum needs to figure out what works best
for their collection.

Happy Friday! We have just been given a hand drawn and painted family
tree, matted and framed. A member of this family built our historic
house, the Hezekiah Alexander House, in 1774, so this is not just a
random piece of art, it has local historical and genealogical
significance. Although a number of the names are misspelled. My question
is, what do you call this when Nomenclature does not admit the existence
of family tree, genealogical chart, or anything else I have been able to
shoehorn this thing into?

Nomenclature is based on function. The object's significance to your
organization should have no bearing on its nomenclature name. That is
something that is recorded elsewhere in your catalog record.=20

It's function seems to be two-fold; one, it is a work of art - a drawing
or a painting. Two, it is a documentary artifact. I would consider
possibly using Manuscript. Although I try to rarely add to nomenclature,
it is by no means complete. I would also feel comfortable adding, Chart,
Family to documentary artifact. If you use Past Perfect, you can choose
the primary function in your mind as the Object Name, and place the
other in Other Name.

tree, matted and framed. A member of this family built our historic
house, the Hezekiah Alexander House, in 1774, so this is not just a
random piece of art, it has local historical and genealogical
significance. Although a number of the names are misspelled. My question
is, what do you call this when Nomenclature does not admit the existence
of family tree, genealogical chart, or anything else I have been able to
shoehorn this thing into?

No, you can add to the Lexicon in 3.5 - if you're referring to Past
Perfect.=20

I wouldn't call a mini-skirted dress a gown unless it is formal in all
other ways but length. You CAN have a very formal short skirted dress.
Just because it was worn for a wedding doesn't make it a Wedding Gown. I
suppose if that makes it easier to find all wedding dresses, you could
use it, but it would be simpler to add a subject of Weddings.

Well, I joined this list thinking that I would lurk and learn, but here I am with
my second query already! I hope I can be helpful to others in the future as they
have been with me this week.
Our small museum has decided that we can no longer afford to supply all things
to all people for free. We want to institute some fees for services, especially for
reproductions of images we own. We have supplied pictures to local restaurants in the
past and to local authors, but feel this needs to change.
What do other museums charge of such things as use of a picture, scanning charges (if done
in-house), handling, finding, etc.?
We were thinking in terms of perhaps $3.50 usage fee for each picture and we would take it
to be reproduced ourselves and then get it back to the researcher--mail it, or they can pick it up.
But we also are considering buying a scanner. What fees are charged for such services?

There were certainly enough horses in the United States to provide a
thriving hide and hair business in the nineteenth century. According
to the census, by 1890, the North Central states alone had over 9 1/4
million horses, mules and asses. Add nearly 2 million from North
Atlantic, 1 1/4 from the South Atlantic, nearly 3 1/2 million from the
South Central states, and 1 1/2 million from the Western states, and
you had about 17 1/2 million horses in the country. There were
proportionately fewer in previous decades, but it was a steady growth
to 1890, roughly doubling from decade to decade.

I disagree with the commentator who suggested horses lived only about
10 years in the 19th century. That age is roughly accurate for the
average lifetime of working oxen, but horses lived a much longer life.
Oxen were butchered and eaten and turned into cowhide. Horses were
mostly slaughtered and turned into horse hide only, a much less
profitable use than meat and hide.

We charge twice the amount the photo shop charges us. This helps defray
the cost of delivering the photos to the shop and picking them up. The
images remain in our hands at all times. Many photo shops are going out of
business due to the digital revolution. We just had to find a new shop and
I had to work out the new price as they charge a $3 scanning fee. Our new
rates are $9 for one 5" x 7" copy, $6 for each copy of the same image
thereafter; and $15 for one 8" x 10" copy, $12 for each copy of the same
image thereafter (they cost us $3 and $6 respectively). We keep the CD
with the digital images in our collection, but we will make them a copy if
they provide us with a CD-R. The researcher may then reproduce the image(s)
in their work with the acknowledgment, "Photo courtesy of..."
