Hi Stephanie

Generally, yes--you'd have to get permission from both (from the owner for access to the piece, and from the artist for permission to copy).  There may be cases where the copyright of the work has been assigned to someone other than the artist, but this is not usually the case, and rarely accompanies the sale of a piece.  Even if the artist is dead, the copyright is preserved for quite some time beyond death, and held by the artist's estate--in Canada, I believe, it's 50 years.

Does anyone know what to do if the owner of an art image and the artist are
not one in the same? Does this mean that anytime they want to give
permission for reproduction/publication, they need to get both the owner of
the image and the artist to grant permission?

Do these rules apply if the artist is no longer living?
