Conner Prairie dispute settled
Former president of the living history museum had sued over his dismissal
last summer by Earlham College.

Earlham College, Conner Prairie and former Conner Prairie President John
Herbst jointly announced today that they have settled a lawsuit involving
Herbst's dismissal last June from his position at Conner Prairie.

They agreed to not publicly discuss the terms of the agreement, according
to a written statement.

The settlement announced today is separate from an ongoing inquiry being
conducted by the Indiana attorney general into Earlham's use of donations
to operate the museum.

Herbst and 27 other members of the Conner Prairie Board of Directors were
dismissed by Earlham on June 11. The next day, Herbst and four of the
dismissed directors filed a lawsuit in Hamilton County challenging
Earlham's action. Conner Prairie, a living history museum located at 13400
Allisonville Road in Fishers, is a subsidiary of the school.

In September, the claims of the other four directors were dismissed by the
court, but not those of Herbst.

Indiana Attorney General Steve Carter announced his inquiry in June. Part
of the money at issue is about $30 million that the late Eli Lilly donated
to Earlham and Conner Prairie in the 1960s and '70s to create and develop
the facility.

Some former board members have said Earlham officials might have withheld
the money from its intended use for Conner Prairie.
