I don't know if you legally have to search but I do know that a common practice
is to get someone in the slot and then advertise the job later. Technically,
you do have to go through the entire hiring process of resume screening and
interviews but obviously the incumbent will have the upper hand. The government
does this all the time and it is legal. (A hint for job seekers is that
announcements that are only open 2 weeks usually have someone slotted in
there.)

Then again, I do know plenty of people with museum and non-profit jobs who got
them and never had to go through a formal hiring process.
