I second what Lori is saying. In general, non-profit organizations are more
generous with leave and flex time because it is the only benefit they are
able to give. Salaries are lower, there are no bonuses, no pension plan, and
often no 401K or health insurance. They have to make the job rewarding in
SOME way, and flex time should be it.

This situation sounds horrific, but not surprising since it is a new
organization. I bet that these folks have not given too much thought to the
legal requirements of hiring staff, nor have they given much thought to what
makes SENSE when hiring staff (ie. "Thou shalt not burn out one's staff and
make them miserable."). You are not being a whiner. I have never known a
non-profit executive who didn't work long hours, and who was not allowed to
take discretionary time. Being an executive director is not a 9-5 job -
which you, and they, obviously know. But it seems like they should choose
between making you work a 9-5 job OR having your there when you NEED to be
there and allowing you to comp time elsewhere. Not both.

There are a lot of elements of this struggle that I have had to deal with in
