Thanks for your note. This, of course, intensities the need for a pre-1978 definition of 'published' as it applies to photographs. For instance:

If a professional photographer takes a picture of a building and offers copies for sale in her gallery, is the photograph published?

If you take a snapshot at a family picnic and offer to have copies made for attendees and your cousin asks for one is that photograph published? Does it matter if the cousin pays you for the copy?

If a photograph you took is displayed on an easel at a public meeting is it published?

Etc, etc, etc.
